برای به دست آوردن اطلاعات بیشتر درباره برخورد قضایی با مقام‌های مذهبی به اتهام‌های آزارجنسی و تجاوز در ایران با ۱۵ چهره که اکنون در حوزه علمیه هستند و یا سابقه حضور در حوزه علمیه را دارند تماس گرفتم که همه آنها حاضر نشدن با نام واقعی خود گفت و گو کنند. بیشتر آن‌ها گفتند تفاوتی بین حوزه علمیه با سربازخانه یا خوابگاه‌های تک‌جنسیتی وجود ندارد و آزارجنسی، تجاوز یا حتی رابطه جنسی میان دو هم‌جنس می‌تواند اتفاق بیفتد که «نه مساله‌ای جدید است و نه خارق‌العاده» بلکه «صدای آن به گوش مردم نمی‌رسد.»
For more information on judicial treatment of religious authorities on charges of sexual assault and rape in Iran, I contacted 15 people who are now in the seminary or have a background in the seminary, all of whom have refused to speak with their real names. Most of them said there was no difference between the seminary or the barracks or single-sex residences, and sex, rape, or even consensual sex between two people of the same gender can happen that is "neither new nor extraordinary" but "it is not talked about".

However, in the history of the Islamic Republic, two prominent religious clerics have been executed for sexual crimes in the 1980s, including Ayatollah Montazeri's memoirs: Omid Najafabadi and Abdur Reza Hejazi. Both men, of course, had political cases: Omid Najaf Abadi, an Isfahan religious cleric, was involved in factional clashes with Mehdi Hashemi, who was later charged with "sodomy" and executed. A former friend of Ahmad Khomeini's nominee, Abdolreza Hejazi, was also mentioned in the Nojeh Coup plot, who was said to have had "relations with married women" in connection with his execution.

یکی از روحانیون در گفت‌وگو با "ایران وایر" اذعان داشت اوایل دهه شصت شاهد سنگسار و اعدام چند روحانی در قم و در ملاعام به اتهام «زنا» و «تجاوز» بوده است ولی از ماهیت پرونده آن‌ها بی‌اطلاع بود.

In a conversation with IranWire, one cleric admitted that in the early 1960s he had witnessed the stoning and execution of several clerics in Qom in public on charges of adultery and rape, but was unaware of the nature of their cases.

In Iran, it is difficult to prove rape or rape. As the lawyer explains: “In order to prove such cases, the rape agent must confess to his crime four times or that four witnesses must be present at the crime scene and accurately observe and narrate the rape. "Not to have seen the nudity, but to have to witness it."

در ایران هم آماری از میزان آزار جنسی در حوزه‌های علمیه وجود ندارد، تاکنون نیز به جز پرونده سعید طوسی، هیچ آسیب‌دیده‌ای حاضر به افشای واقعیت نشده است. اما همان‌طور که تنی چند از روحانیون فعلی و سابق در گفت‌وگو با "ایران وایر" تاکید کردند اگر کسی «ذوب در ولایت» بوده یا از روابط ویژه‌‌ای با بیت رهبری برخوردار باشد، می‌تواند شامل حمایت های لازم برای  مختومه کردن پرونده شود.

In Iran, there is no statistics of sexual harassment in the seminaries, so far, with the exception of the case of Saeed Tusi, no victim has been present to disclose the facts. But as some current and former clerics have argued in an interview with IranWire, if someone is "thawed in the province" or has a special relationship with the leadership, it may include the support needed to close the case.


طبق قانون اساسی جمهوری اسلامی ولی فقیه و افرادی که از جانب او نمایندگی دارند یعنی مجتهدانی که منصوب وی هستند به عنوان حاکم شرع می‌توانند مجرمی را که جرمش ثابت هم شده، بنا به مصلحت بالاتری عفو کنند: «اقدامی که نه غیرقانونی و نه غیرفقهی است بلکه به دیکتاتوری می‌ماند که طبق قانون دیکتاتوری عمل می‌کند. مصلحت نظام از اوجب واجبات است که تمامی این برخوردها را توجیه می‌کند.»

According to the constitution of the Islamic Republic of Iran, the Supreme Leader and the people represented by him, the jurists who are appointed by him as the religious ruler, can pardon the offender whose crime has been proven, if they consider it more expedient: "An act that is neither illegal nor non-Islamic Rather it is a dictatorship that operates in accordance with the dictatorship law. The expediency of the system is a necessity that justifies all these clashes. "

The teenager talked, with difficulty, of how his life had been destroyed since the fateful day in June 2002 when he refused to have sex with his teacher at a religious school in Pakistan.
The boy was horrifically injured in an acid attack after he rebuffed the Muslim cleric's sexual advances. Now, he has alarmed Pakistan's powerful religious establishment by pressing charges against his alleged assailants.
A teacher at the school, who cannot be named for legal reasons, and two of his friends are in prison awaiting trial for attempted murder and rape. All three deny the charges. A fourth alleged attacker is still at large.

15 June 2006: The mother of an ll-year-old girl who was allegedly raped by 50-year-old pir in Saeedabad filed a case in the Mochko police station last month against him and said that she will not accept the money that the pir’s family is reportedly offering for her to drop the charges. Shamim, the girl’s mother, alleges that her daughter ‘N’ was not the only person the Pir has raped. According to her, she had sent her daughter and two sons to Hakim Sarwar’s madrassa, as she could not afford to send them to school.

THE FORMER principal of an Islamic school in Jamaica charges in a federal lawsuit that he was dismissed after complaining that his 13-year-old daughter was sexually abused by a school employee. Reza Naqvi claims he was fired from his $35,000 job at the Al-Imam School, at 89-89 Van Wyck Expressway, two months after he pressed criminal charges against the school's maintenance director, Adnan al-Harbi. According to court records, Harbi is accused of accosting the teen in the boiler room in December 2003, fondling her and trying to kiss her. When Naqvi learned of the assault on his daughter a month later, he did not immediately report the alleged attack to the police. Instead, he notified Sheik Fadhel al-Sahalani, who is the director of the Imam Al-Khoei Islamic Center, which operates the school. Naqvi even suggested that Sahalani "act as a judge of the situation by having both al-Harbi and his daughter swear on the Holy Book and explain their versions of what had transpired," according to the lawsuit filed in Brooklyn Federal Court. But Sahalani allegedly failed to take any action. In New York City public schools, a principal who fails to immediately report to police a sex crime allegedly committed by a student or school employee would be subject to termination, said an Education Department spokesman. Harbi was arrested in April and charged with sexual abuse, endangering the welfare of a child and harassment, according to the Queens district attorney's office. "By March 2006, I had no choice but to file criminal charges against Mr. al-Harbi for the sexual molestation of my daughter," Naqvi said in a news release sent to the Daily News. Naqvi was barred from his office in June after three years on the job. He claims in the suit that Harbi is still employed at the school. Naqvi's lawyer, Joshua Nessen, explained that his client did not immediately notify police about the incident because of "cultural differences.

30 Jan 2007: Kot Sultan, Layyah District
On 30 January 2007, 15 year-old Asma Shah from Town Layyah in Punjab province, was allegedly kidnapped by five alleged perpetrators, Sajjad Hussain, Mohammad Ashraf, Munna Qasai, Muneer Gujjar and Nasir Hussain Shah. They are members from the Imambargah Pur Sultan, a religious place of the Shia sect of Islam, they are very powerful in the local area. The victim had allegedly been raped over a four-day period by several influential people, including some politicians. After she was released, her family immediately went to the Kot Sultan Police station in Layyah District, Punjab province to lodge a complaint. However the police refused to register the case. It was reported that several politicians including Malik Niaz Ahmed Jhakar (the member of National Assembly), Ajaz Ahmed Achlana (the member of provincial assembly of Punjab province) and Malik Iftekhar Ahmed Jhakar (Chief of Town council, Layyah), each called the victim’s family and forced them to drop the case.

As a result of a local court order, the police on Thursday handed over the possession of a detoxification centre to its controversial head, Maulana Ilyas Qadri.
The Idara Tark-i-Manashiaat (centre for detoxification) was sealed last year and Maulana Qadri was charged with sexually and physically abusing the centre’s inmates.

9 Feb 2010: A RELIGIOUS leader has been jailed for punching and kicking a nine-year-old boy, then beating him with a bamboo stick.
Gulam Hussain, 44, of Knotts Green Road, in Leyton, was jailed for 12 weeks today at Walthamstow Magistrates' Court after pleading guilty to common assault by beating.
The court heard that Hussain, who was an Imam at The Jamia Mosque [Ghousia] in Lea Bridge Road, Leyton, had previously been cautioned in 2005 for a charge of actual bodily harm (ABH) against an 11-year-old.
Chair magistrate Dr Paul Davis told Hussain through an Urdu interpreter that he was being jailed, “for the protection of the public”.

DARGAI: A teacher of a Jamaat-e-Islami-run madrassa was forced to walk naked in the bazaar on the charge of molesting a minor in Sakhakot area in Malakand Agency on Friday as the party leaders refuted the allegation and termed it part of a conspiracy.

Sources said the teacher in Madrassa Taleemul Quran, Qari Sajid Mehmood, allegedly molested a six-year-old child whose name is being withheld and is resident of Sakhakot.

Several Iranian dissident sites posted the video, but the hosting companies ordered the video removed because of its upsetting content. The unobscured video appeared June 7 on HolyCrime.com, an Iranian human rights website that documents the crimes of the mullahs in the Islamic Republic of Iran. As of today, that video was still online.
We know that the video was shot at the Hozeh Elmieh Seminary in Qom, Iran. We do not know the name of the mullah, but he is identifiable as a Shi'ite clergyman by his white turban, known as an amameh. The mullah is not wearing the amameh on his head. He is using it as kneepads while raping the boy. Judging by the boy's demeanor, this incident does not appear to be the first time he was sexually assaulted.
The mullah is also wearing a long robe called a ghaba, which Shi'ite clergy wear to symbolize the righteousness of the prophet Mohammed.
The person who shot the video, apparently via cell phone, held the lens at a 90 degree angle through the slats in the screen.
We are not implying that the crime is in any way typical of mullahs, but we do believe it is evidence of the impunity with which corrupt mullahs can operate in the Islamic Republic of Iran.

26 Sep 2010: MIANWALI: Isakhel Additional Sessions Judge Abdul Haq Jappa cancelled the bail of an accused involved in the gang rape of a seminary student. 

Complainant Hafiza Shafia Saeed, 16, alleged that she was a student of a seminary at Astana Aalia Nooria Koh Chandan where Rashiduz Zaman, grandson of Pir Muniruz Zaman, and another student Muhammad Tariq raped her and made her obscene videos. She said that the accused used to rape her. She said later the accused sold her to Ayaz Khan, a resident of Lakki Marwat, on the pretext of marrying her. After sometime, the victim contacted her parents and her father Muhammad Saeed brought her back to Kot Chandana after paying money. 

The victim tried to get a case registered with the Kalabagh police, but failed to do so. The additional sessions judge ordered the Kalabagh police to register a case against the accused under section 376, 371 A & B of the PPC, but the police registered a case under section 376 of the PPC.

18 March 2011: Mohammed Hanif Khan, 43, was told he must spend at least eight years in jail after being found guilty by a jury at Nottingham Crown Court of sexual activity with a child, as well as the two counts of rape.
The charges relate to two boys who attended the [Barelvi] mosque in Capper Street, Stoke-on-Trent, where he was imam, in 2009.

In another incident, a student of class four was beaten at Dar-e-Arqam Model High School in Sadiqabad in Rahim Yar Khan district.
Ahmad Anwar told The Express Tribune that the school principal entered the class after hearing him talk to his class teacher. He said the principal beat him brutally for raising his voice.
His father said that he jad talem Ahmad to a private hospital where doctors had recommended two weeks of bed rest. “The are bruises all over his body,” he said.

BAHAWALPUR / FAISALABAD: 

A four-year-old schoolboy was allegedly gang-raped by a school principal and his accomplices in Faisalabad on Wednesday.
Angry relatives of the boy staged a demonstration against the school administration and demanded the public hanging of the principal and others involved, besides closing down the school.
The protesters also burnt tyres and blocked the main Narwala Road, suspending traffic. The father of the four-year-old victim told the media that his son, M*, was a kindergarten student at the Dar-e-Arqam School where he was subjected to gang rape by the school principal, the watchman and two others.

A case was registered against a seminary head for allegedly attempting to sexually harass a student in a village of Ali Khan union council, the police said on Tuesday.
City police quoted Mehtab of Palghar Jogi village as saying his 12-year-old nephew Shahwar* was enrolled for last few years at Jamia Taleemul Quran, Ghosiya Mehriya in Moonan village.
...Upon Mehtab’s insistence, Shahwar disclosed that when he was leaving for the holidays, the seminary in charge Pir Tanvir Malangi took him to his room and reportedly abused. Shahwar said Malangi also tried to molest him but failed as some students knocked on the door.

After a 15-year-old boy was found murdered at a local seminary on Monday, police arrested three clerics of the religious school for killing the boy after subjecting him to rape.
The body of victim Abdul Rehman was found in a pool of blood in the courtyard of the mosque-cum-seminary, Madressah Jamia Masjid Pir Mehar Ali Shah, located in Islamnagar locality, by his fellow students when they woke up early morning for Fajr prayers.
The prime suspect, Qari Abdul Hameed alias Chishti and his alleged accomplices -- Qari Samiullah and Qari Muhammad Khalil -- who had escaped after committing the heinous crime were later arrested, District Police Officer Rai Ejaz Ahmed told Dawn.

20 Oct 2015: AN ISLAMIC teacher who tried to silence two boys he sexually abused by threatening them with black magic was today jailed for 12 months.
Self-styled faith healer, Kamran Bashir, molested the children, aged 13 and 14, after inveigling them to an address in Bradford to instruct them in the Koran.
He groomed them on Facebook before touching them indecently in what the Recorder of Bradford, Judge Roger Thomas QC, labelled "an absolutely enormous breach of trust."
Bashir, 30, of Duckworth Lane, Girlington, Bradford, was convicted by a jury at Bradford Crown Court last month of three offences of sexual activity with a child.

MANCHESTER: Minhajul Quran Islamic Center’s director has been sentences to 12 months imprisonment and fined one thousand pounds by a court in Manchester for attempting to rape a fellow worker of the Tehrik.  
The director Haroon Abbas who is pupil of Pakistan Awami Tehrik (PAT) Chairman Tahirul Qadri will remain in police supervision for next five years. The victim, Gulnar told the court that the convict tried to molest her in a closed-door room.
Narrating the later related incidents, she told the court that Abbasi on other occasions also attempted similar molestations, which made her badly terrorised. She told the court that she flinches when she hears name of any molvi or going near Minhajul Quran mosque. Surprisingly, the Minhaj has suspended the director only temporarily, despite such serious crime.

30 Sep 2016: An imam is to stand trial accused of attacking a seven-year-old boy during an Arabic lesson at a mosque.
Hafiz Rizvi, a cleric at the Masjid Tajdar-e-Madina Mosque in Dundee, was arrested over the incident earlier this year.
He is accused of repeatedly slapping the boy on the head at the Victoria Road place of worship on August 22.
On Friday, Dundee Sheriff Court was told the incident had occurred during an Arabic lesson Rizvi was holding.
Defence solicitor Scott Norrie said: "He is an imam and teaches a variety of children's groups at the mosque.
"There have been no difficulties since this matter."
Hafiz Rizvi, of Dundee, denied the assault charge.
Sheriff Simon Collins QC set a trial date in January and ordered the 38-year-old to attend a pre-trial hearing in December.

Rape victims are coming forward alleging the one of Iran’s leading Quran readers sexually molested them.
Saeed Toosi is considred one of Iran’s most celebrated Quran reader and was once considered an “exemplary model to be followed” according to Khamenei, current Supreme Leader of Iran.
The 46-year-old representative of Iran in the international Quranic competition, and the winner of the first prize both internationally and locally, has reportedly raped seven of his students aged between 12 ad 14, during the past seven years.
They decided to shed light on their cases and bring it to the public while an Iranian court attempts at covering up the sexual scandal under supposed direct orders from the Khamenei and the Supreme Judicial authorities.
Toosi adds up to a growing list of scandal facing Tehran, after series of economic ones have preoccupied the Iranian public.
In a television program broadcasted by The Persian Voice of America , three of the rape victims said that they have written evidence and audio recordings clearly pointing to Toosi in which he admitted with his own handwriting that it his actions were a “mistake”.
In an audio recording , Toosi is heard saying the that Khamenei is well aware of the situation, and had agreed with the head of the judiciary authority Sadek Larijani to cover up the case in order to safeguard the reputation of the Quranic institution in Iran.
One of the victims, a first prize winner in one of the recent Quranic competition, alleged that Toosi took advantage of him when he was his companion for a competition abroad. He deliberately booked one hotel room where he molested and raped the then 12-year-old.
The victims added that they filed complaints against the Quranic reader to officials in the House of the Leadership after they were were advised to. Yet officials have ignored their claims after receiving a“repentance letter “ where Toosi admitted his wrongoing and claimed “he is a changed man”.

27 Oct 2016: Iran’s most senior judiciary official has announced that people who give interviews to foreign media could face harsh punishment after rape victims gave interviews to Voice of America’s Persian-language TV network.
On Monday, October 24, he announced that anyone found to be cooperating with or giving interviews to media outlets that authorities deem to be in opposition to the values of the Islamic Republic of Iran would be considered to be guilty of “giving assistance to a crime.” 
On October 14, Voice of America (VOA) broadcast phone interviews with several young Iranian boys who said they had been raped by a famous Koran reciter. 
Saeed Tousi, who works and teaches for the Koran High Council as an expert in adolescent affairs, was named as the defendant in the rape case, and was alleged to have raped the boys, all of whom were his students.

The parents of an 11-year-old boy accused a seminary cleric of severely torturing their son for not memorising a lesson in Vehari district of Punjab.
Syed Iftikhar Hussain Shah Bukhari, a resident of Ludan, told reporters, on Tuesday, that his son Muhammad Bilal is enrolled at Faizan-e-Madina madrassa where teacher Qari Muhammad Fiaz beat him up severely.
According to Bukhari, Bilal had not memorised a lesson so Fiaz, the cleric, got angry and punched the 11-year-old in his stomach and face breaking several teeth. Fiaz then also used a steel rod to beat Bilal before shaving his head, said the father.

گھوٹکی میں عوام نے لڑکی کو مبینہ طور پر اغوا کرنے کی کوشش کرنے والے جعلی پیر کو پکڑ کر پولیس کے حوالے کردیا۔ لڑکی پیر کی قید سے فرار ہوکر اپنے گھر پہنچی تھی۔
سندھ کے علاقے گھوٹکی میں بااثر پیر نے اپنے ساتھیوں کے ہمراہ لڑکی کو مبینہ طور پراغوا کرنے کی کوشش کی۔ چیخ و پکار پر اہل محلہ جمع ہوگئے جنہیں دیکھ کر پیر کے چیلے فرار ہوگئے تاہم جعلی پیر لوگوں کے ہاتھ لگ گیا۔
اہل محلہ نے ملزم کو پولیس کے حوالے کردیا۔ متاثرہ لڑکی نے بتایا کہ ایک سال قبل مرتضی نامی شخص نے اسے شادی کا جھانسہ دے کر پیر کو فروخت کر دیا تھا۔ پیر ایک سال تک حویلی میں قید رکھ کر زیادتی کا نشانہ بناتا رہا۔
لڑکی کے مطابق موقع ملنے پر گزشتہ روز وہ پیر کی قید سے فرار ہوکر اپنے گھر پہنچی جہاں سے پیر نے اسے اغوا کرنے کی کوشش کی۔

Saeed Tousi, the Koran teacher who was accused of child molestation, has been aquitted. Tehran’s appeals court reached the verdict on January 26. 
In an interview with BBC Persian [Persian link], Tousi confirmed that he has been acquitted and denied reports that the office of the Supreme Leader had influenced the outcome in his case.
But in a tweet, Mahmoud Sadeghi, an outspoken reformist member of the parliament, said that people with links to Ayatollah Khamenei’s office had pressured the Iranian judiciary and had blatantly derailed the judicial process.

The Federal Investigation Agency's (FIA) cyber crime wing on Thursday arrested a man posing as a pir (faith healer) for allegedly sexually abusing women and then blackmailing them.
A resident of Haripur, the man is accused of harassing women who approached him for solutions to their problems, the FIA said. He would then use the videos and pictures of the women to blackmail them.

ملزم گرفتارواقعات کے مطابق متوالی رضا عباس ہمدانی نے عثیم عباس کو گھر پر ملازم رکھا ہوا تھا کہ ملزم کمسن بیٹے قاسم رضا سے زبردستی بدفعلی کررہاتھابچے کی چیخ وپکار پر شہریوں نے ملزم کو قابو کرلیا۔پولیس تھانہ غلہ منڈی نے رضا عباس کی مدعیت میں مقدمہ 376ت پ درج کرکے ملزم کو حراست میں لے لیا
