میٹھے میٹھے اسلامی بھائیو! دیکھا آپ نے ؟ رَمَضانُ المبارَک کی تعظیم کے سَبَب ایک آتَش پَرَست کو اللہ عَزَّوَجَلَّ نے نہ صِرْف دَولتِ اِیمان سے نَوازدیا بلکہ اُس کو جنّت کی لازَوال نعمتوں سے بھی مالا مال فرمادیا ۔اِس واقِعہ سے خُصُوصاً ہمارے اُن غافِل اِسلامی بھائیوں کو دَرسِ عِبرت حاصِل کرنا چاہئے جو مسلمان ہونے کے باوُجُود رَمَضانُ المُبارَک کا بِالکل اِحتِرام نہیں کرتے۔اَوَّل تو وہ روزہ نہیں رکھتے، پھر چوری اور سینہ زَوری یُوں کہ روزہ داروں کے سامنے ہی سگریٹ کے کَش لگاتے ، پان چباتے ،حَتّی کہ بَعض تَو اتنے بیباک و بے مُرَوَّت کہ سرِ عام پانی پیتے بلکہ کھانا کھاتے بھی نہیں شرماتے۔ یا د رکھئے ! فُقَہائے کِرام (رَحِمَھُمُ اللہ تعالٰی ) فرماتے ہیں،''جو شَخص رَمَضانُ الْمُبارَک میں دن کے وَقت بِغیر کِسی مَجبوری کے عَلی الْاِعلان جان بُوجھ کر کھائے پئے اُس کو(بادشاہِ اسلام کی طرف سے )قتل کردیا جائے۔''

The Islamic penalty for drinking is eighty lashes. Eighty lashes are given when the person drinks it for the first time. If he repeats the act after receiving 80 lashes he is lashed 160 times. If he repeats the sin again and confesses, or two just witnesses testify before a Qazi (religious Judge) the punishment is tripled; i.e. 240 lashes. The fourth instance of the crime entails capital punishment. Some Mujtahids are of the opinion that capital punishment should be given when the sin is repeated the third time.
If a person confesses and repents before the testimony of two just witnesses, he is condoned. However after the testimony he cannot escape punishment. The drunkard cannot be punished while still intoxicated. He is punished only when he gets sober. If it is a man he is stripped above the waist and lashed from the shoulders and below. It is not allowed to hit the face or the private parts of the accused. If the accused is a woman she is lashed with her clothes on. If her dress is loose, it is made to stick to the body by tying it up. She is lashed in a sitting position.
If a person drinks wine at a sacred place, for example the Holy Kāba or in a sacred period, like the month of Ramadhan, he is lashed and also given a preventive punishment that is, he is beaten so much that he may not dare to repeat the crime.

Punishment for Intentionally Breaking Your Fast for Three Days

عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ مُحَمَّدِ بْنِ عِيسَى عَنْ يُونُسَ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللَّهِ ع قَالَ مَنْ أُخِذَ فِي شَهْرِ رَمَضَانَ وَ قَدْ أَفْطَرَ فَرُفِعَ إِلَى الْإِمَامِ يُقْتَلُ فِي الثَّالِثَةِ
“Whoever is caught in the month of RamaDaan and he is breaking (his fast), he is taken to the Imaam, and he is killed in the third (offense)”

I do not understand why Al-Majlisi has graded this hadeeth as Muwaththaq (Reliable), since all of the narrators in the chains are thiqaat (pl. thiqah) and a 12’er Shee`ah. This hadeeth should be graded as SaHeeH.

From Burayd Al-`Ijlee said: Aboo Ja`far (عليه السلام) was asked about a man who witnesses upon him (say) they witness that he broke (his fast) from the Month of RamaDaan three days. So he (عليه السلام) said: “Ask him: ‘Do you (belief) that breaking (your fast) is a sin?’ And if he says: “No”. It is upon the Imaam (leader) that he kills him, and if he says “Yes”, then it is upon the Imaam that he strikes him hard (?)”

Extract from page 177 of the book 'Shara'i' al-Islam fi masa'il al-halal wa al-haram':
12) A person breaking the fast in the month of Ramadan, knowingly and deliberately, will be liable to ta'zir (chastisement) in the first time. If he repeats breaking the fast, he will be liable to ta'zir again. If this act is repeated for a third time he should be killed.

13) Whoever copulates with his fasting wife forcibly in the month of Ramadan (during time of fasting), will be liable to two kaffarahs, and nothing is required of her. But if she submits to him willingly, the fast of both of them will be invalidated, and everyone will be liable to kaffarah individually, and to ta'zir of 25 lashes. And so also is the rule when coercion to sexual intercourse is perpetrated with a foreign woman. Some legists observed: he is not liable to ta'zir but to two atonements only.

Grand Ayatollah al-Khoei: A person who breaks the fast during Ramadan, knowingly & deliberately, is an apostate. He's liable to ta'zir of 25 lashes for 1st and 2nd time, and is killed for 3rd time but as a precaution, he should be killed for 4th time.

Muqtada Al-Sadr: Iraqi youngsters eating or drinking in public will be tied to electricity posts

A senior Shiite cleric says anyone found breaking their fast in public during the Muslim’s holy month of Ramadan will be severely punished.

Moqtada Sadr, the cleric with a heavily armed military wing and vigilante groups, particularly in central and southern Iraq, said if the government did not prevent people from eating and drinking in public in Ramadan his armed men were ready to stop them.

Restaurants and cafes are closed from dawn to dusk in Iraq and Iraqis are forbidden from eating, smoking or drinking in public.

The government has issued orders to punish anyone violating the Ramadan fast in public, but Sadr says they were not strictly applied.

Sadr’s representative in the southern city of Nasiriya, Naseer al-Mawsawi, said the group’s vigilante were ready "to take matters into their hands and tie anyone found breaking their fast to an electricity post under the scorching sun."

He said the measures taken by the country’s security organs and police forces were not enough and fell short of the tough restrictions former Iraqi leader Saddam Hussein had in place.

"If the government does not stop people eating and drinking in public, we are capable of forming youth groups, arrest these infidels (the violators of Ramadan fast) and tie them on electricity posts in the street," Mawsawi said.

Two men were flogged in public in the south-central Iranian city of Shiraz for eating during fasting hours in the holy month of Ramadan.
Fasting in Ramadan is considered a religious duty for Muslims.
The police chief of Iran's Fars Province, Ahmad Ali Goudarzi, was quoted by Iranian media on July 13 as saying that each of the men received 80 lashes.

23 July 2014:  An Iranian judge sentenced a Christian man to have his lips burnt with a cigarette for eating during the day in the Muslim holy month of Ramadan.
The barbaric punishment was carried out in public in a square in the city of Kermanshah.
Five other Muslim men were also flogged in public with 70 lashes for not fasting during Ramadan, the city's deputy governor Ali Ashraf Karami said.

The October report submitted to the UN by Special Rapporteur for Human Rights in Iran, Dr. Ahmed Shaheed, cited a semi-official news outlet as the source of information on the government's punishment of more than 480 people by flogging during the first 15 days of Ramadan for not observing fasting requirements. The government officially reported only three flogging punishments for failure to observe Ramadan.

Dadkhoda Salari, the prosecutor general in the city of Kerman said on Friday: “Any individual who eats or drinks in public places could face a prison term of 10 days to two months and 74 lashes,” the state-run Mehr news agency reported.
Another state-run news agency warned the public that special patrols have been stationed at streets and public parks in Tehran during the holy month of Ramadan to deal with those who drink, eat or smoke in public.
“The police will deal with those individuals who smoke, drink water and other liquids, eat a snack or food in public,” the state-run ISNA news agency reported.
Last year hundreds of Iranians were lashed in public under the medieval laws of the religious dictatorship which can sentence offenders to 74 lashes and two months in prison for eating during Ramadan.
At least 200 people were flogged in last year in the Iranian province of Qazvin for eating in public during Ramadan.
In 2014, Qazvin official Ismail Sadeghi-Niaraki acknowledged the scale of medieval punishments now being carried out within the regime under the rule of so-called 'moderate' president Hassan Rouhani.
He said: "Exceptional measures were taken by the judiciary in Qazvin province during the month of Ramadan to deal with those eating in public.”
"Over this period, 400 people were arrested and some were given warnings. Another 200 had their cases reviewed by the judiciary and the flogging sentence was carried out within 24 hours of their arrest."
Last year, a Christian man in Iran was sentenced to have his lips burnt with a cigarette for eating during the day in Ramadan. The savage punishment was carried out in public in the city of Kermanshah.

According to this official, in Shiraz alone, “20 government and non-government organs” and 248 patrol teams carry out this oppressive scheme under the pretext of “fighting non-observance of fasting”.
Also, according to the commander of the security forces of Hamadan Rassoul Moradi, 100 were arrested by the Basij Force for not fasting. His deputy stated that 700 groups from the Basij or suppressive forces of the regime “have been formed in Hamadan to promote virtue and prevent vice to fight those who do not observe fasting in public”.
On June 22, ninety-two boys and girls were arrested in Shahriar International Hotel of Tabriz on similar charges. Many of the arrestees were travelers that based on Islamic regulations were not in a condition to fast.
In the first week of Ramadan in Ilam alone, security forces arrested 200 and within a day barbaric decrees to flog them were issued.

On May 30, Traffic Police Chief General Taghi Mohri warned that during Ramadan, drivers and passengers could be arrested for not wearing the hijab properly or eating or drinking in public.
“It’s true that a vehicle is an example of a private space, but it’s not the same as a house,” said Mohri. “Therefore, citizens should observe Sharia laws inside their cars, particularly during the (Muslim) holy month of Ramadan.”
Children, people with health problems, travelers and non-Muslims are excluded from the ban on eating or drinking in public during Ramadan.
Iran’s Islamic Penal Code does not specifically prohibit the consumption of food or water during Ramadan.
It does, however, discuss “sinful” acts in Article 638: “Anyone in public places and roads who openly commits a harām (sinful) act, in addition to the punishment provided for the act, shall be sentenced to two months’ imprisonment or up to 74 lashes; and if they commit an act that is not punishable but violates public prudency, they shall only be sentenced to ten days to two months’ imprisonment or up to 74 lashes.”

At least 20 Iranian citizens were lashed in the country's north western province of Qazvin due to breaking of the Ramadan fast.
Prosecutor of Qazvin province, Esmail Sadeghi Niaraki said that the mentioned persons were sentenced to fine and lash due to eating in public during fasting hours in the month of Ramadan, Iran's Mehr news agency reported on June 11.
He further said that so far 90 people have been arrested in Qazvin due to breaking of the Ramadan fast, adding that a special court is reviewing their cases.
Fasting in Ramadan month is considered a religious duty for Muslims.
It is said that according to the law in Iran, people who break their fasts in public are liable to between 10 to 60 days in prison or 74 lashes.

Baghdad (IraqiNews.com) Iraqi authorities will prosecute people violating the Muslim daytime fasting rituals.
The Interior Ministry said in a statement on Thursday it was “taking legal measures against people publicly breaking their fast (during day time) and refer them to the judiciary”.
....The ministry added it emphasized on closing alcoholics stores and restaurants during fasting times, with exceptions made for restaurants at factories, student hostels and tourist-class restaurants on highways.
The closures will cover coffee shops, and it is also “not allowed to run artistic shows or any activities that do not correspond to the sanctity of the holy month”, according to the statement.
